These Terms & Conditions ("Terms") govern your use of SaybySong (the "Service", "we", "us", "our"), operated by UPYOJAN PRIVATE LIMITED at this website. By creating an account, placing an order, or otherwise using the Service, you agree to these Terms.

1Who we are

2Products & services

We create personalized, AI-assisted birthday songs and videos based on the information, memories, and preferences you provide during an interactive interview. All prices are listed in Indian Rupees (INR) and are shown to you before payment. Current formats and prices:

• Only audio song (MP3) — ₹250
• Song with lyrics imprinted as video, without vocals (MP4) — ₹300
• Song with lyrics imprinted as video, with vocals (MP4) — ₹350
• Video with photos, set to the finished song (MP4) — ₹550

Prices may change from time to time; the price shown at checkout for your order is final and will not change afterward. Applicable promo codes are applied before payment and shown on the payment step.

3Accounts

You must sign in with a valid Google account to create a song. You're responsible for the accuracy of the information you submit (names, pronunciations, relationships, dates, and any photos or special requests) and for keeping your account access secure.

4Orders & delivery

After you approve your lyrics and complete payment, we generate your song or video and deliver it by email, typically to the email address linked to your account. You may optionally schedule delivery to a recipient's email at a future date/time, up to 30 days out, as described at checkout.

5Content & intellectual property

You retain rights to the personal information, memories, and photos you submit. By submitting them, you grant us a limited license to use them solely to generate, deliver, and support your order. The finished song or video is licensed to you for personal, non-commercial use (sharing with friends and family, social media, etc.). You may not resell or use the output for commercial purposes without our written permission. You must have the right to submit any photos you upload and must not submit content that is unlawful, infringing, or that you do not have permission to use.

6Payments

Payments are processed securely through Cashfree Payments. We do not store your card, UPI, or bank credentials. The final price for your order is calculated and verified on our servers at the time of payment.

8Acceptable use

You agree not to use the Service to create content that is illegal, defamatory, hateful, or that infringes the rights of others, and not to attempt to disrupt, reverse-engineer, or abuse the Service.

9Limitation of liability

The Service is provided "as is". We make reasonable efforts to ensure the quality of generated songs and videos but do not guarantee a specific creative outcome. To the maximum extent permitted by law, our liability for any claim relating to an order is limited to the amount you paid for that order.

10Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

11Governing law

These Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh.
